ALD Ventures Inc. (“ALD Ventures,” “we,” “us,” or “our”), owner and distributor of Facial Pain Mobile] (the “App”), respects your privacy and is committed to protecting it through our compliance with this Privacy Policy. This policy describes the type of information we may collect or that you may provide to us when you access or use the App and how we collect, store, transfer, and use such information. By using and accessing the App, you signify your acceptance of our Privacy Policy. If you do not agree to the terms of this Privacy Policy, do not use, download, install, register with, or otherwise access the App. Please read our Privacy Policy in its entirety.
Capitalized terms used, but not defined herein, will have the meanings assigned to such terms in the App’s Terms of Use Agreement (the “Agreement”), which is available here.
Information Collection
By using the App, you agree that we are permitted to receive, collect, and own information from or about you depending on the nature of your interaction with the App. You may provide us with information when: (i) downloading and installing the App; (ii) registering/signing up for services provided by the App; or (iii) using the App. This information includes Personal Information, App Use Information, and Provided Information as defined below, which along with any other information or materials submitted by a User to the App are collectively referred to herein as “User Information.”
“Personal Information” is information that can be used to directly identify an individual user. Examples include name, gender, date of birth, email address, physical address, mobile phone number, and user interactions with the App that are connected to other identifying information.
“App Use Information” is information that we collect based on user interaction with the App. Examples include time spent using the App, tracked interactions with certain features on the App, Internet protocol (IP) address, mobile ad ID, operating system, hardware version, device settings, device identifiers, language, time zone, and location and/or GPS data.
“Provided Information” is information that the user voluntarily provides when using the App. Examples include medical condition information, pain data, medical, physician and drug history, diagnosis information, answers to questionnaires or surveys, reports, and other voluntarily provided information.
ALD Ventures does not sell, rent, loan or otherwise distribute any of your User Information (including, but not limited to, your name, email address, phone number, mobile location, or any other identifiable Personal Information about you) to any third party, without your prior consent, except as set forth in this Privacy Policy and the Agreement.
Examples of our data collection practices are provided below.
- We may collect Personal Information about you when you register for an account, such as your name and email address.
- We may collect App Use Information in connection with your use of the App to the extent that such App Use Information cannot be used to directly identify Personal Information of a User.
- We may use cookies or other technical instruments to monitor your usage of the App. “Cookies” are small data files assigned to device when you use the App which enable recognition of your device and collect and store App Use Information regarding your use of the App, as described above. It may be possible to refuse to accept mobile cookies by activating the appropriate setting on your mobile device. However, if you select this setting you may be unable to access certain parts of our App.
- We may collect App Use Information about your mobile device and internet connection, including the device’s unique device identifier, operating system, browser type, mobile network information and the device’s telephone number.
Use of Your Information
ALD Ventures may use your User Information to:
- provide and improve the services and functionality offered by the App, including addressing technical issues, errors, bugs, or glitches, presenting the App and its Content in the most effective manner to your device, and to personalize Content and make suggestions or recommendations on the App;
- identify when and how you use the App;
- create lists of third party health care providers qualified to address diagnoses created using the Provided Information;
- communicate with you about the App, for example, to provide you with the lists of third party health care providers or to provide notifications (including push notifications) and notices about such lists, your account or updates to the App;
- produce aggregate statistical data and other analytics for the improvement of services offered by ALD Ventures or its affiliates or for any other reason determined by ALD Ventures;
- carry out our obligations and enforce our rights pertaining to any agreements entered into between you and ALD Ventures; and
- for other legitimate purposes associated with protecting your interests, our interests and those of third parties, including, keeping our services safe and secure, and when obtaining professional advice (for example, from lawyers).
Notwithstanding anything to the contrary in this Privacy Policy, ALD Ventures may be required to disclose your User Information in response to inquiries by law enforcement officials or under and pursuant to applicable laws and regulations. ALD Ventures also may use your User Information to defend itself in litigation or in a regulatory or administrative action.
Information Sharing
We will not share or disclose your User Information and it will be kept confidential in accordance with privacy laws and will not be shared or released without your permission except as described in this Privacy Policy, except to the extent that such information can be used anonymously:
- to enhance the App;
- to maintain the App and provide other administrative services (including, but not limited to, maintaining and analyzing data, providing end user support);
- to fulfill a request made by you, including sharing any User Information you provided when using the App, such as medical or diagnostic information and contact details;
- to comply with the law or in the good faith belief that such action is necessary in order to conform to the requirements of law or comply with legal process served on us, to protect and defend our rights or property, or the rights and property of our affiliates, or to act in urgent circumstances to protect the personal safety of our end users and systems;
- to track and analyze non-identifying and aggregate usage and volume statistical information; and
- to protect against potential fraud.
Data Retention Policy
We keep your User Information for as long as is necessary for the purposes for which it is processed. These periods vary depending on the nature of the information and your interactions with us.
When the purposes for which we processed your User Information have concluded, we will either permanently delete or destroy the relevant User Information or anonymize it, in a manner that ensures individuals are no longer identifiable.
Children’s Privacy
The App is not intended for children under the age of 13 and we do not knowingly collect any information from children under the age of 13. Please contact us using the information provided in the “Contact Us” section below if you believe we have collected personal information from anyone under the age of 13 without proper consent.
We also strongly encourage parents and guardians to supervise their children’s online activities and to consider using parental control tools available from online services and software manufacturers to help provide a child-friendly online environment. These tools also can prevent children from disclosing online their name, address, and other personally identifiable information without parental permission.
Updating / Removing Your Personal Information
If you do not want your personal information used by ALD Ventures as provided in this Privacy Policy, you should not use the App. You can correct, update or review User Information you have previously submitted by going back to the specific feature on the App where you provided it, logging-in and making the desired change. You can also update any User Information you have submitted by contacting us using the contact information listed below in the “Contact Us” section.
f you have registered and desire to delete any of your registration information you have provided to us from our systems please contact us using the contact information listed below in the “Contact Us” section. Upon your request, we will delete your registration information from our active databases and where feasible from our back-up media. You should be aware that it may not be technologically possible to remove each and every record of the information you have provided to the App from our servers.
Your California Privacy Rights and Do Not Track Disclosures
California Civil Code Section 1798.83 permits our visitors who are California residents to request certain information regarding our disclosure of personally identifiable information to third parties for their direct marketing purposes. To make such a request, please contact us using the information in the “Contact Us” section below.
Note to Users Outside of the United States
ALD Ventures and our technical infrastructure are located in the United States. The User Information that you provide to us is stored on servers located in the United States. If you are located in another jurisdiction, you should be aware that in order to provide the services of the App to you, we must transfer your User Information to the United States where it will be stored and processed in accordance with this Privacy Policy. We may transfer your information outside the United States to service providers with operations in other countries. By using the App, you consent to such collection, storage and processing in the United States and elsewhere, though the United States and other jurisdictions may not afford the same level of data protection as considered adequate in your own country. We will take reasonable steps to protect your personal information. Note that your personal information may be available to the United States government or its agencies under legal process made in the United States.
Assignment
In the event that all or part of our assets are sold or acquired by another party, or in the event of a merger, you grant us the right to assign the User Information that we collect from you.
Security
We use commercially reasonable efforts to secure your information from accidental loss and from unauthorized access, use, alteration and disclosure. However, the safety and security of your Information also depends on you. Where we have given you (or where you have chosen) a username and password for access to the App, you are responsible for keeping such credentials secure and strictly confidential. We are not liable for any loss, breach or compromise of your information caused by or related to your failure or negligence to keep your credentials secure and confidential.
Unfortunately, the transmission of information via mobile platforms and the internet is not completely secure. Although we use commercially reasonable efforts to protect your information, we cannot guarantee the security of your information transmitted through the App. Any transmission of information is at your own risk. We are not responsible for any loss or unauthorized access to your information or any circumvention of any privacy settings or security measures we provide.
Updates to This Policy
We reserve the right, at our discretion, to change, modify, add, or remove portions from this Privacy Policy at any time and any changes will be effective upon being posted unless we advise otherwise. You are responsible for regularly reviewing this Privacy Policy and additional terms posted for the App. Your continued use of the App following the posting of changes to this Privacy Policy constitutes your agreement to such changes. We encourage you to periodically review this Privacy Policy for the latest information on our privacy practices. If you do not accept the terms of this Privacy Policy, we ask that you do not use the App, and to delete the App and all of its related Content immediately.
